Legislation Alert

Senate Transportation Committee Chair, Martin M. Dilan, is sponsoring a bill recently reported by his committee, which has raised concerns by counties and towns throughout the state. This legislation, S.5711-A, is designed to enable safe access to public roads by requiring that bicycle and pedestrian ways be included in the planning and development of state, county, and local transportation facilities, plans, and programs.

If enacted, this legislation would be extremely costly to local governments and highway departments, creating inordinate project delays and possibly making many projects too expensive to go forward. Therefore, NYSCHSA has joined with NYSAOTSOH, New York Association of Counties, and the Association of Towns of the State of New York opposing this bill. After meeting with Senator Dilan's staff to discuss the difficulties and financial burdens this bill will cause for local governments already struggling with limited resources to address a transportation infrastructure in crisis. Senator Dilan's office agreed to continue to work together with NYSCHSA and the other stakeholders to insure that the bill will not be a burden on local transportation budgets.

Last week a hearing before the NYS Assembly Transportation Committee was held on very short notice on November 12th, 2009. Randy Gibbon, Co-Legislative Chair, Chenango County traveled to Albany to present the Assocation's joint testimony with Dave Bell, Town of Chester, NYSAOTSOH.
